Seeking Ownership Information for Community Cemetery
NOTICE REGARDING COMMUNITY CEMETERY OF BELHAVEN
NOTICE is hereby given by The Town of Belhaven, North Carolina, (“Town”) by and through the undersigned Town Manager, and pursuant to Article 17 of the North Carolina General Statutes and Section 92 of the Town of Belhaven Code of Ordinances, of the following action in regard to COMMUNITY CEMETERY and the rights to the lots and burial spaces therein:
(1) The rights to the lot designated PLOT 12 and all 8 gravesites therein have no listed owner in the records of the Town, and, after reasonable inquiry, the Town has not been able to find a present owner or claimant for such lot, THERFORE the Town shall sell or resell said lot designated PLOT 12 pursuant to §92.46(A) of the Town Code beginning December 1, 2020.
ANY PERSON CLAIMING OWNERSHIP OF AN INTEREST IN PLOT 12, BY PREVIOUS PURCHASE, TRANSFER, OR OTHERWISE, IS HEREBY GIVEN NOTICE TO MAKE CLAIM, IN WRITING, FOR THE CLAIMED INTEREST, TO THE UNDERSIGNED NO LATER THAN November 15, 2020. Failure to provide the claim as specified shall result in the sale by the Town of said lot.
(2) Pursuant to the provisions of §92.46(B) of the Town Code, the Town declares that the following lots in COMMUNITY CEMETERY have been previously purchased but no payment has been made for the care to the Town for the past 20 years, therefore under the authority of the aforementioned Town Code, the remaining gravesites on such lots are hereby declared open and available for sale by the Town said gravesites being as follows:

ANY PERSON CLAIMING OWNERSHIP OF AN INTEREST IN ANY OF SAID LOTS AND DISPUTING THE ASSERTION THAT NO PAYMENT HAS BEEN MADE IN AT LEAST THE PAST 20 YEARS, IS HEREBY GIVEN NOTICE TO PRESENT EVIDENCE IN DISPUTE THEREOF REGARDING PAYMENT, TO THE UNDERSIGNED NO LATER THAN November 15, 2020.
(3) Pursuant to the provisions of §92.45 of the Town Code, the Town hereby extends an offer to purchase in COMMUNITY CEMETERY any lot or gravesite which has been previously purchased or transferred to any party other than the Town. Owners of any such lots should contact the Town Manager.
